Terms of Use
The rules for using Odds on Me and Odds on Me Pro, governed by Indian law, with a plain English summary under every section.
How to read this page. Each section ends with a shaded plain English summary. The summaries are there to help; if a summary and the full text differ, the full text applies.
1. Agreement
These Terms of Use (the “Terms”) are a legally binding agreement between you and Noaman, an individual developer based in India (“we”, “us”, “our”). They govern your use of Odds on Me for iPhone, including its widgets, Lock Screen widgets, Control Center control, Siri and Shortcuts actions, share cards, exports and all updates (together, the “App”), and of the optional Odds on Me Pro subscription.
By downloading, installing, opening or using the App, or by subscribing to Pro, you confirm that you have read and accept these Terms and our Privacy Policy. If you do not agree, do not use the App.
These Terms are an electronic record under the Information Technology Act, 2000 and the rules made under it, and do not need a physical or digital signature. They are published in accordance with the Consumer Protection (E-Commerce) Rules, 2020.
These Terms apply in place of Apple’s standard Licensed Application End User License Agreement, except that section 26 (Terms required by Apple) and, where these Terms say nothing on a point, Apple’s Media Services Terms and Conditions also apply.
2. How these Terms work for users in different countries
The App is offered from India to users in many countries. These Terms are governed by Indian law (section 29). However, if you are a consumer, nothing in these Terms takes away any right you have under the mandatory consumer-protection laws of the country where you live. Where those laws give you more protection than these Terms, they apply. Appendix A sets out additional terms for particular countries and regions. If Appendix A conflicts with the main Terms, Appendix A applies to users in that country.
Each section ends with a Plain English Summary. The summaries are there to help. If a summary and the full text differ, the full text applies.
3. Definitions
| Term | Meaning |
|---|---|
| Your Content | Everything you enter in the App: predictions, confidence figures, results, captions and settings. |
| Prediction or call | A statement you write about something that may happen, with a confidence from 50 to 99%. |
| Pro | Odds on Me Pro, the optional auto-renewing subscription described in section 10. |
| Apple | Apple Inc. and its affiliates, which distribute the App and process all payments. |
| Consumer | An individual using the App for purposes outside their trade, business or profession. |
4. Who may use the App
Minimum age. You must be at least 13 years old to use the App. Where the law of your country sets a higher minimum age for using online services, you must meet that age.
Minors. In India, a person under 18 is a minor and cannot enter into a binding contract (Indian Majority Act, 1875 and Indian Contract Act, 1872). The same is true in many other countries below the local age of majority. If you are a minor, you may use the App, and buy Pro, only with the consent and supervision of your parent or lawful guardian, who accepts these Terms on your behalf and is responsible for your use and purchases. Parents can manage purchases through Apple’s Family Sharing, Ask to Buy and Screen Time.
Capacity and legality. You confirm that you are legally able to accept these Terms, that you are not barred from using the App under any law that applies to you, and that you are not located in a country, or listed on a government list, that prohibits you from receiving the App (section 30).
No accounts. The App has no user accounts. Your purchase is tied to your Apple Account.
5. Availability
We decide in which App Store countries and regions the App is offered, and we may add or remove countries at any time. We do not promise that the App is suitable, lawful or available in every location. If you use the App from a place where it is not offered, or where using it is unlawful, you do so at your own risk and are responsible for complying with local law. The App may not be offered in mainland China or in other countries that require licences or registrations we do not hold.
The App requires iOS 17 or later. Some features need newer versions of iOS (for example, the Control Center control needs iOS 18 or later). Features may stop working on older versions of iOS after future updates.
6. Your licence
We grant you a personal, limited, non-exclusive, non-transferable, non-sublicensable and revocable licence to download, install and use the App on Apple-branded devices that you own or control, for your own personal, non-commercial use, subject to these Terms and to the Usage Rules in Apple’s Media Services Terms and Conditions. The App is licensed, not sold. We and our licensors keep all rights not expressly granted to you.
7. What the App is, and what it is not
7.1 A tool for self-reflection and entertainment
The App lets you write down predictions about your own life, state how confident you are, record what happened, and see how well your confidence matched reality. Scores, skill figures, levels, streaks, the Mirror, patterns and reveal lines are statistical summaries of what you typed in, produced for self-reflection and entertainment.
7.2 Not gambling, not betting, not an online money game
The App uses words such as “bet”, “call”, “odds” and “stake” only in a figurative sense. The App does not involve money, wagers, deposits, odds offered by anyone, prizes, rewards, winnings or anything of monetary or exchangeable value. The Pro subscription is a payment for software features; it is never a stake and cannot be won or lost. Nothing in the App can be converted into money, credits, tokens or anything of value.
The App is not a gambling, betting, wagering, lottery, prediction-market or fantasy-sports service, and is not an online money game within the meaning of the Promotion and Regulation of Online Gaming Act, 2025 or any similar law. Its use is not covered by the Public Gambling Act, 1867 or any State gambling law, because it involves no stakes and no prizes. You must not use the App, or anything exported or shared from it, to place, record, settle or advertise real-money bets or wagers.
7.3 Not professional advice
Nothing in the App is financial, investment, legal, medical, psychological, therapeutic, educational or any other professional advice. A pattern such as “Overconfident about people” is a simple observation about your own numbers. It is not an assessment of your character, abilities, intelligence or mental health. Do not make important decisions based on the App. If you are struggling with how you feel, please speak to a qualified professional. In India you can call the Tele-MANAS mental-health helpline on 14416; elsewhere, please contact your local emergency or support services.
7.4 Reveal lines
Reveal lines are short, light-hearted messages written in advance and chosen automatically based on your confidence and result. They are about your number, never about you as a person. We try hard to keep them kind, but we do not promise that every line will suit every moment. If any line upsets you, please tell us at [email protected] and we will review it.
7.5 Results are self-reported
You decide whether each prediction came true. We do not and cannot verify results. Mistaken or dishonest results affect only your own statistics. The App’s figures are only as meaningful as your honesty, and you must not present them to anyone as independently verified.
8. Your Content
8.1 You own it
You own Your Content. It is stored only on your device (see the Privacy Policy). We do not receive it, access it or need any licence to it.
8.2 Locked records
When you save a prediction, its text, confidence and creation time are locked, so that you cannot rewrite what you believed after the outcome is known. You can delete an open prediction at any time, undo a result within 10 minutes, and delete all data at any time. A resolved prediction cannot be edited or deleted on its own. You accept these rules as a deliberate feature of the App.
8.3 Your responsibilities
You are solely responsible for Your Content and for anything you share from the App. You must not write or share anything that is unlawful, defamatory, obscene, harassing, threatening, hateful, invasive of anyone’s privacy, infringing of anyone’s rights, or that would break the Information Technology Act, 2000, the Bharatiya Nyaya Sanhita, 2023, or any other applicable law. Many predictions mention other people. Please be respectful, and do not include sensitive details about others.
8.4 Back up your data
Your Content exists only on your device and in your own backups. We have no copy and cannot recover it. Losing, resetting, replacing or damaging your device, deleting the App, or a failed backup can permanently erase it. Use Settings > Export everything (JSON) regularly for anything you want to keep.
9. Scores, streaks and levels
9.1 How they work
- Score: a calibration score based on the Brier score, shown once you have resolved 20 predictions.
- Streak: a day counts if you resolve at least one prediction on it. One free “freeze” each calendar week (Monday to Sunday) automatically covers one missed day.
- Levels: these depend on how many predictions you have resolved, the share of your predictions made at 50 to 80% confidence, and your skill on those predictions.
The full rules are explained in the App under You > How scoring works.
9.2 Your device’s clock
Due times, reminders, streaks, weeks and scores rely on your iPhone’s date, time and time zone. Travelling across time zones, daylight-saving changes, or changing your device clock can affect when predictions are due, how days are counted, and your streak. Changing your clock to affect your statistics is not a supported use, and we are not responsible for results caused by an incorrect clock.
9.3 No value, and rules may change
Scores, streaks, levels and freezes have no monetary value, cannot be transferred or exchanged, and are not prizes. We may adjust the rules in future versions to make them fairer, clearer or more accurate. Where possible, changes will be calculated from your existing records rather than reset them.
10. Free features and Odds on Me Pro
10.1 Plans
The App is free to download and use. Odds on Me Pro is an optional paid subscription that adds extra features. At the time these Terms were written:
| Feature | Free | Pro |
|---|---|---|
| Score, reveals, streak, levels, calibration curve | Yes | Yes |
| Widgets, including the large “Last 5 calls” widget | Yes | Yes |
| Open predictions at one time | Up to 5 | Unlimited |
| History and search | Last 30 days | Full history |
| Export everything as JSON | Yes | Yes |
| CSV export and stats report | No | Yes |
| Category breakdown and insights | One pattern line | Full breakdown |
| “Resurface” of confident misses after 3 days | No | Yes |
| Themes for the widgets and share cards | Classic | All themes |
| Share-card formats, typefaces and layout options | Yes | Yes |
10.2 Our commitments
We will not put your score, reveals, streak, levels or calibration curve behind a paywall, and we will always let you export all your data as JSON for free. We may change, add or remove Pro features and change the free limits over time. We will describe any material change in the App’s release notes, and a change will never take away something you have already paid for during your current subscription period without a refund being available through Apple.
11. Subscription terms
11.1 Seller, price and taxes
Pro is sold and billed by Apple as an auto-renewing monthly subscription. The price is shown on the App’s paywall and in the App Store before you confirm your purchase, for example ₹59 per month in India. Prices in other countries are set in local currency through Apple’s pricing system. Prices shown in India include GST, which Apple collects and pays. In other countries, prices include or add applicable taxes such as VAT or sales tax, as Apple shows at checkout. Payment is charged to your Apple Account when you confirm the purchase.
11.2 Automatic renewal
Your subscription renews automatically every month at the then-current price unless you cancel at least 24 hours before the end of the current period. Your Apple Account is charged for the renewal within the 24 hours before the current period ends.
11.3 Payment methods in India
If you pay through a card, UPI or other method registered in India, Reserve Bank of India rules on recurring payments may require you to set up or approve a standing instruction (e-mandate), and you may receive a pre-debit notification before each renewal. If the mandate is declined, expires or is revoked, the renewal may fail. These processes are run by Apple and your bank or payment provider, not by us.
11.4 Failed payments
If a renewal payment fails, Apple may retry it for a period. Where Apple offers a billing grace period, Pro stays active during that period while Apple retries. If payment still cannot be collected, Pro ends. The App shows a notice in Settings when Apple is having trouble renewing your subscription.
11.5 Managing and cancelling
You can manage or cancel at any time in iPhone Settings > your name > Subscriptions, or in the App under Settings > Manage subscription. Deleting the App does not cancel your subscription. Cancellation takes effect at the end of the period you have already paid for, and you keep Pro until then. Because the subscription is held by Apple, we cannot cancel it for you, but we will gladly guide you through it.
11.6 Price changes
If the price changes, Apple will tell you in advance and, where Apple’s rules or the law require, ask for your consent before the new price applies. If you do not agree to an increase, you can cancel before it takes effect.
11.7 Refunds
All payments are processed by Apple, and refund requests are decided by Apple under its policies. To request a refund, visit reportaproblem.apple.com or contact Apple Support. We cannot issue refunds directly. This does not affect any refund or cancellation right you have under consumer law (see section 11.8 and Appendix A).
11.8 Your statutory rights, including the right to withdraw
Depending on where you live, you may have statutory rights that cannot be excluded. For example, consumers in the European Union, EEA and United Kingdom generally have a 14-day right of withdrawal from contracts for digital services, which Apple honours for App Store purchases under its terms. By subscribing, you ask for Pro to be made available immediately, and you acknowledge that, where the law allows, this may affect your right of withdrawal. Consumers in Australia have guarantees under the Australian Consumer Law. Consumers in India have rights under the Consumer Protection Act, 2019. See Appendix A.
11.9 Trials and offers
The App does not currently offer a free trial. If we introduce a trial, introductory price, promotional offer, win-back offer or offer code, its terms will be shown before you accept it. Any unused part of a free trial ends when you buy a subscription.
11.10 Family Sharing, several devices and changing countries
Pro is not shared through Apple Family Sharing. It works on every iPhone signed in to the Apple Account that bought it. Your data, however, is not synced between devices (see the Privacy Policy). If you move your Apple Account to another country or region, Apple’s rules on subscriptions and prices for that region apply.
11.11 Restoring
If you reinstall the App or use a new iPhone with the same Apple Account, an active subscription is recognised automatically. If it is not, tap Restore purchase. You must be signed in to the Apple Account that bought it. A subscription bought through Apple cannot be moved to a different Apple Account or to another platform.
11.12 Chargebacks
If you dispute a charge with your bank or card provider instead of asking Apple for a refund, Apple may cancel the subscription and Pro will end.
11.13 When Pro ends
When Pro ends for any reason (cancellation, a failed payment, a refund, or a chargeback):
- Your data is not deleted. Open predictions stay open and can still be resolved.
- If you have more than 5 open predictions, they all remain, but you cannot add a new one until you are under the free limit.
- History older than 30 days is hidden in the History screen but not removed. It still counts towards your score and is still included in the JSON export.
- Pro themes switch back to Classic on the App, widgets and share cards. CSV and stats exports, the full category breakdown and Resurface switch off.
- You can subscribe again at any time to get them back.
11.14 If we stop offering Pro
We may stop offering Pro, or stop offering the App, with reasonable notice. If we do, we will turn off renewals in advance where Apple allows, so that you are not charged for a period in which Pro would not be available. The free features and the JSON export will keep working on your device for as long as iOS runs the App.
12. Fair design: no dark patterns
We design the App in line with the Guidelines for Prevention and Regulation of Dark Patterns, 2023 issued by India’s Central Consumer Protection Authority, and with similar laws elsewhere. This means: no false urgency or fake scarcity; no hidden costs (the price, billing period and renewal terms are shown before you subscribe); no subscription traps (cancelling is as easy as subscribing, through Apple); no confirm-shaming; no nagging (the full upgrade screen appears at most once a week when you reach the free limit, and the 20-call insights prompt appears once); no disguised advertisements; and no bait and switch. If you think anything in the App falls short of this, please tell us.
13. Notifications and reminders
The App schedules notifications on your device to remind you when predictions are due, plus an optional weekly Mirror reminder. Delivery depends on iOS and your settings: notification permission, Focus modes, Do Not Disturb, Low Power Mode, Scheduled Summary, Apple Intelligence features, and iOS limits (the App schedules the nearest 60 reminders at a time). Reminders are a convenience and are not guaranteed. Do not rely on the App for anything time-critical, medical, legal, financial or safety-related, and do not use it as an alarm or calendar.
14. Widgets, Control Center, Siri and Shortcuts
These features are provided through iOS, which we do not control. How often widgets refresh, whether buttons respond immediately, and whether Siri understands a request all depend on iOS, your device and its settings, and they may be delayed, limited or changed by Apple. Widgets can show prediction text, confidence and results on your Home Screen and Lock Screen. You are responsible for what your screen shows to others. You can hide text and confidence in Settings and on each widget.
15. Sharing and exports
The App can create share cards and export files and hand them to the iOS share sheet. You alone decide whether, how and with whom to share them, and you are responsible for what you share and for its consequences, including any names, private details or personal data of other people that appear in your predictions or captions. Do not use share cards to harass, defame, mislead, threaten or target anyone. Share cards show the App’s name; do not alter a card to misrepresent it (for example, to make a self-reported result look verified or to suggest an endorsement by us).
16. Acceptable use
You must not, and must not help or allow anyone else to:
- copy, modify, translate, adapt, reverse engineer, decompile, disassemble or try to extract the source code of the App, except to the extent that applicable law allows this despite this restriction;
- remove, change or obscure any notice, trademark, name or logo in the App or on share cards;
- bypass, disable or interfere with the subscription, paywall, StoreKit, licence checks or any security feature, or try to get Pro features without paying;
- use the App on a jailbroken or modified device to unlock features or alter its behaviour;
- use the App or anything from it for any unlawful, fraudulent, harmful, harassing, defamatory or abusive purpose, or to stalk, monitor or intimidate anyone;
- use the App to place, record, settle or promote real-money bets, wagers, lotteries or online money games (section 7.2);
- falsify your statistics (for example, by changing your device clock or tampering with storage) and present them to others as genuine;
- sell, rent, lease, sublicense, distribute, publish or commercially exploit the App or any part of it;
- use bots, scripts or automation to interact with the App in bulk, or place an unreasonable load on any Apple service through the App; or
- use the App in any situation where its failure could lead to death, injury, or serious damage to property or the environment.
17. No social features and no hosting of content
The App has no feed, no messaging, no accounts and no way for users to send content to each other through us. We do not host, store, publish or moderate user content, so we are not an intermediary for Your Content under the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, nor a hosting service under the EU Digital Services Act. If you believe the App itself is being used to cause harm, or that any built-in text in the App (such as a reveal line) is objectionable, contact [email protected]. We will acknowledge reports within 24 hours on working days and act on them promptly.
18. Intellectual property
The App, including its software, design, icon, name, logo, interface, widget designs, share-card designs, the written copy (including the library of reveal lines), and all related rights, belongs to us or our licensors and is protected by copyright, trademark and other laws of India and other countries. These Terms give you no ownership of any of it. “Odds on Me” and the App’s logo are our trademarks. You must not use them in a way that suggests our endorsement, or as part of any other product name, without our written permission. Your Content remains yours.
If you send us feedback, ideas or suggestions, you allow us to use them freely to improve the App, without any obligation or payment to you.
19. Privacy
Your use of the App is also governed by our Privacy Policy, which explains that your App data stays on your device and that we do not collect it. Please read it.
20. Apple and other third parties
The App relies on services provided by Apple, including the App Store, StoreKit, iOS, notifications, widgets, Siri, Shortcuts, iCloud and backups, Apple Intelligence and the share sheet. These services are governed by Apple’s terms, and we are not responsible for their availability, changes, failures or data handling. Apps, services or people you share content with are governed by their own terms.
21. Updates, betas and the App’s lifetime
We may release updates that add, change or remove features, fix problems, improve security or comply with the law. Updates are delivered through the App Store; some may be needed to keep using the App or to use it on newer versions of iOS. Beta versions distributed through TestFlight may be unstable, may lose data, and are provided for testing only, under Apple’s TestFlight terms. We may change, suspend or stop the App, or any feature, at any time. We will try to give reasonable notice of significant changes, but may not be able to for urgent security, legal or technical reasons. If the App is removed from the App Store, copies already installed may keep working, but may stop receiving updates.
22. Disclaimers
To the fullest extent permitted by law, the App is provided “as is” and “as available”, and we make no promises or warranties, express or implied, including about merchantability, satisfactory quality, fitness for a particular purpose, accuracy, reliability, non-infringement, or uninterrupted, timely, secure or error-free operation. We do not promise that reminders will be delivered, that widgets will refresh, that calculations or reveal lines will suit you, that the App will be free of bugs or security weaknesses, or that it will always be available or compatible with your device.
Data loss. Your data is stored only on your device. We have no copy and cannot recover it. You are responsible for backing up your device and exporting your data.
Your statutory rights are not affected. Some laws do not allow certain warranties to be excluded. In that case, these disclaimers apply only to the extent the law allows. In particular, they do not limit any right you have as a consumer under the Consumer Protection Act, 2019 (India), the Australian Consumer Law, the UK Consumer Rights Act 2015, the EU’s rules on the conformity of digital content and services, or similar laws.
23. Limitation of liability
To the fullest extent permitted by law:
- we are not liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for loss of data, records, streaks, profits, revenue, goodwill or opportunity, or for any decision you make based on the App, however caused, even if we were told it was possible; and
- our total liability to you for all claims connected with the App or these Terms is limited to the greater of (a) the total amount you paid for Pro in the 12 months before the event giving rise to the claim, and (b) ₹1,000 (one thousand Indian rupees), or its equivalent in your currency.
Nothing in these Terms excludes or limits liability that cannot be excluded or limited by law, including liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, for wilful misconduct or gross negligence, for breach of any non-excludable consumer guarantee, or for any liability under applicable product-liability law. Additional country-specific limits are in Appendix A.
24. Indemnity
To the extent permitted by law, you agree to compensate us for any third-party claims, losses, damages and reasonable costs (including reasonable legal fees) that arise from your breach of these Terms, your misuse of the App, or content you share from the App that breaks the law or another person’s rights. This section does not apply to consumers where local consumer law does not allow it.
25. Ending this agreement
You may stop using the App at any time by deleting it. Remember to cancel your subscription separately (section 11.5). We may suspend or end your licence if you materially break these Terms, if the law requires it, or if we stop offering the App. When the agreement ends, you must stop using the App and delete it. Sections 7, 8, 16, 18 and 22 to 32 survive the end of the agreement.
26. Terms required by Apple
These terms apply because you obtained the App from Apple’s App Store. They are between you and us, not Apple, but Apple has the rights described below.
- Acknowledgement. You and we acknowledge that these Terms are concluded between you and us only, and not with Apple. We, not Apple, are solely responsible for the App and its content.
- Scope of licence. The licence granted to you is limited to a non-transferable licence to use the App on any Apple-branded products that you own or control, as permitted by the Usage Rules in Apple’s Media Services Terms and Conditions, except that the App may be accessed and used by other accounts associated with you through Family Sharing or volume purchasing where the App permits.
- Maintenance and support. We are solely responsible for providing any maintenance and support services for the App, as described in these Terms or as required by law. Contact: [email protected]. Apple has no obligation to furnish any maintenance or support services for the App.
- Warranty. We are solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. If the App fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price of the App (if any) to you. To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the App, and any other claims, losses, liabilities, damages, costs or expenses attributable to any failure to conform to a warranty are our sole responsibility.
- Product claims. We, not Apple, are responsible for addressing any claims by you or any third party relating to the App or your possession or use of it, including product liability claims, claims that the App fails to conform to any applicable legal or regulatory requirement, and claims arising under consumer protection, privacy or similar legislation.
- Intellectual property rights. If a third party claims that the App or your possession and use of it infringes that third party’s intellectual property rights, we, not Apple, are solely responsible for the investigation, defence, settlement and discharge of that claim.
- Legal compliance. You represent and warrant that you are not located in a country that is subject to a US Government embargo or that has been designated by the US Government as a “terrorist supporting” country, and that you are not listed on any US Government list of prohibited or restricted parties.
- Developer name and address. Questions, complaints or claims about the App should be directed to Noaman, India, [email protected].
- Third-party terms. You must comply with applicable third-party terms of agreement when using the App, such as your mobile network operator’s terms.
- Third-party beneficiary. Apple and Apple’s subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.
27. Grievance redressal (India) and support
In accordance with the Consumer Protection (E-Commerce) Rules, 2020, the Information Technology Act, 2000 and the rules under it, and the Digital Personal Data Protection Act, 2023:
| Item | Details |
|---|---|
| Grievance Officer | Noaman |
| [email protected] | |
| Location | India. We do not publish a street address; please contact us by email. |
| Acknowledgement | Within 48 hours of receiving your complaint |
| Resolution | Within one month of receiving your complaint |
Please include the email address or Apple order ID linked to your issue, a description of the problem, and what you would like us to do. Do not send us your predictions or payment details. Support is provided in English and, on request, in Hindi.
28. Accessibility
We aim to make the App usable by everyone. It supports VoiceOver labels, Dynamic Type for most text, Reduce Motion, light and dark appearance, and haptics. If something is hard for you to use, please tell us at [email protected] and we will try to fix it.
29. Governing law and disputes
Governing law. These Terms, and any dispute or claim arising from them or from the App, are governed by the laws of India, without regard to conflict-of-law rules.
Talk to us first. Before starting any formal proceedings, please contact our Grievance Officer (section 27) and give us 30 days to try to resolve the matter informally.
Courts. Subject to the rest of this section, the courts at Lucknow, Uttar Pradesh, India have exclusive jurisdiction.
Consumers in India. Nothing in these Terms affects your right to file a complaint before the appropriate Consumer Disputes Redressal Commission under the Consumer Protection Act, 2019, including online through the e-Daakhil portal (edaakhil.nic.in), or to seek help from the National Consumer Helpline (call 1915, or visit consumerhelpline.gov.in).
Consumers outside India. If you are a consumer living outside India, you also keep the protection of the mandatory laws of your country, and you may bring proceedings in the courts of the place where you live if your local law gives you that right. Consumers in the EU may also use an approved alternative dispute resolution body in their country. We are not obliged to take part in ADR, but we may agree to.
Urgent relief. Either of us may ask any competent court for urgent interim relief, for example to protect intellectual property.
30. Export control and sanctions
You must comply with all export-control and sanctions laws that apply to you, including those of India, the United States, the European Union and the United Kingdom. You may not download or use the App if you are located in, or ordinarily resident in, a country or territory subject to comprehensive sanctions, or if you are a person or entity listed on a sanctions list, where that would break such laws.
31. General
- Entire agreement. These Terms, the Privacy Policy and the Apple terms referred to in them are the entire agreement between you and us about the App, and replace any earlier understanding.
- Severability. If any part of these Terms is held invalid or unenforceable, the rest stays in force, and the invalid part will be read in the way that is closest to its original intent while being lawful.
- No waiver. If we do not enforce a right straight away, we have not given it up.
- Assignment. You may not transfer your rights or obligations under these Terms. We may transfer ours to a successor of the App (for example, if the App is sold or transferred to a company we set up) as long as your rights, including the privacy commitments in the Privacy Policy, are not reduced.
- Notices. We may give you notice through the App, in the App Store release notes, or by email in reply to a message you sent us. You may give us notice by email at the address in section 27.
- Force majeure. We are not liable for any delay or failure caused by events beyond our reasonable control, including natural disasters, epidemics, war, government action, power or internet outages, and failures or changes of Apple’s services or iOS.
- Language. These Terms are written in English. We may provide translations, including into Hindi and other Indian languages, on request. If a translation differs from the English version, the English version prevails, except where the law of your country requires otherwise.
- Headings and summaries. Headings and Plain English Summaries are for convenience only and do not change the meaning of the Terms.
- No partnership. Nothing in these Terms creates a partnership, agency, employment or fiduciary relationship between you and us.
32. Changes to these Terms
We may update these Terms from time to time, for example when the App changes or the law changes. The version and date are shown at the top. For material changes, we will tell you through the App or the App Store release notes at least 14 days before they take effect, except where a change is required urgently by law or for security. Changes do not apply retroactively. If you keep using the App after a change takes effect, you accept it. If you do not agree, stop using the App and cancel any subscription before it next renews.

- Consumer protection. You have all rights under the Consumer Protection Act, 2019 and the Consumer Protection (E-Commerce) Rules, 2020. Section 27 sets out our grievance details, and section 29 explains how to approach a Consumer Commission or the National Consumer Helpline (1915).
- Seller information. The seller of the App’s software licence is Noaman, India. The Pro subscription is sold and billed through Apple’s App Store, which collects payment and GST.
- Price display. The total price, including GST, is shown before you subscribe, together with the billing period and the fact that the subscription renews automatically.
- Refunds and cancellation. Refunds are handled by Apple (section 11.7). You can cancel at any time (section 11.5), and you keep Pro until the end of the period you paid for.
- Online gaming and gambling. The App is not an online money game, does not offer or facilitate any game played for stakes, and offers no winnings or prizes (section 7.2).
- Minors. Under-18s may use the App and subscribe only with the consent of a parent or lawful guardian (section 4).
- Privacy. See the Privacy Policy, including its Appendix A.1, for your rights under the Digital Personal Data Protection Act, 2023.
A.2 European Union and European Economic Area
- Statutory guarantee. You have the legal guarantee of conformity for digital content and digital services under EU law, as implemented in your country. Nothing in these Terms limits it.
- Right of withdrawal. You generally have 14 days to withdraw from a purchase of digital services without giving a reason. Withdrawal is exercised through Apple, under Apple’s terms for EU customers.
- Liability. Section 23 does not limit liability for intent, gross negligence, injury to life, body or health, or breach of essential contractual obligations, where the law of your country does not allow such limits. For simple negligence in breach of an essential obligation, liability is limited to the damage that was typical and foreseeable when the contract was made.
- Your courts. You may bring proceedings in the courts of the country where you live, and the mandatory consumer law of that country applies.
- ADR. You may use an approved alternative dispute resolution body in your country.
A.3 Germany and Austria
In addition to A.2, the limitations in sections 22 and 23 do not apply to liability for intent or gross negligence, under product-liability law, for injury to life, body or health, or for breach of a guarantee we have given. For slight negligence, we are liable only for breach of material contractual obligations (Kardinalpflichten) and only up to the typical, foreseeable damage.
A.4 United Kingdom
You have rights under the Consumer Rights Act 2015, including that digital content must be of satisfactory quality, fit for purpose and as described, and rights under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013. Nothing in these Terms affects those rights. You may bring proceedings in the courts of England and Wales, Scotland or Northern Ireland, depending on where you live.
A.5 United States
- Auto-renewal disclosures. Before you subscribe, the App and Apple show the price, the billing frequency, the fact that the subscription renews automatically until cancelled, and how to cancel, as required by state automatic-renewal laws (including California’s). You can cancel online at any time through Apple.
- Disclaimers. Some states do not allow the exclusion of implied warranties or the limitation of incidental or consequential damages, so parts of sections 22 and 23 may not apply to you.
- New Jersey. Nothing in these Terms limits any right you have under the New Jersey Truth-in-Consumer Contract, Warranty and Notice Act; any provision that would be unenforceable in New Jersey does not apply to New Jersey residents.
- No class-action waiver or mandatory arbitration. These Terms do not require arbitration and do not waive class actions.
A.6 Australia
Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. For major failures with a service, you are entitled to cancel your service contract and to a refund for the unused portion, or to compensation for its reduced value. You are also entitled to choose a refund or replacement for major failures with goods. If a failure does not amount to a major failure, you are entitled to have problems with the service rectified in a reasonable time and, if this is not done, to cancel and get a refund for the unused portion. Sections 22 and 23 apply only to the extent permitted by the Australian Consumer Law.
A.7 New Zealand
If you acquire the App as a consumer, the Consumer Guarantees Act 1993 and the Fair Trading Act 1986 apply, and nothing in these Terms limits them.
A.8 Canada and Quebec
Nothing in these Terms limits your rights under provincial consumer-protection laws. If you live in Quebec, the Consumer Protection Act (Quebec) applies, these Terms will be interpreted in your favour where there is doubt, and you may bring proceedings in Quebec. The parties have agreed that these Terms be drafted in English; vous pouvez demander une version française en écrivant à [email protected].
A.9 Japan
Nothing in these Terms excludes our liability for damage caused by our intent or gross negligence, as required by the Consumer Contract Act. Where we are liable for slight negligence, sections 22 and 23 apply to the extent the Act permits.
A.10 South Korea
You may withdraw from a subscription purchase within the period and on the terms set by the Act on Consumer Protection in Electronic Commerce, through Apple. Nothing in these Terms limits your rights under Korean consumer law.
A.11 Brazil
You have rights under the Consumer Defense Code (Código de Defesa do Consumidor), including the right of withdrawal within 7 days for purchases made outside a commercial establishment, exercised through Apple. Nothing in these Terms limits those rights.
A.12 Everywhere else
Wherever you live, you keep every right your local law gives you as a consumer that cannot be excluded by contract. If any part of these Terms is not enforceable where you live, it does not apply to you, and the rest of the Terms still applies.
